Whether a fruiterer who sells fireworks at the time when a youngster's fancy lightly turns to thoughts of crackers is obliged to close his shop at six o'clock, in accordance with the provisions of the Shops and Offices Act was a question considered at the Magistrate's Court yesterday By Mr E Page, S.M. The Labour Department for whom Mr. R. T. Bailey appeared, proceeded against several Chinese fruiterers, all of whom were represented by Mr. O. A. L. Treadwell, on charges of failing to close their shops at the specified time. The defendants, who disputed the Department's interpretation of the Act, were Wong Tong and Co., Cuba street, Ngan Tong and Sons, Owen street, and Shim Hoo Ching, Aro street. Mr. Bailey urged that once a fruiterer sold anything but the usual stock of a fruiterer he placed himself outside the law unless he closed his shop at the hour specified in the Act. The opposite view was adopted by Mr. Treadwell, who submitted that no offence had been disclosed in view of the conditions of. the Act. The case, he said, was one of Borne interest, and was of great importance to fruiterers in the city of Wellington. Decision was reserved.
